Does Medicare Cover CBD Oil?

Yes, Medicare can cover CBD oil for eligible patients through a program called the Substance Access Benefit Enhancement Initiative (BEI). This isn't a standard Medicare benefit you'll find on your card. It works through Accountable Care Organizations (ACOs) that choose to participate. What Is the Substance Access BEI?

The Substance Access Benefit Enhancement Initiative is a pilot program run by the CMS Innovation Center. It lets ACOs include qualifying CBD products as a supplemental benefit for their Medicare patients. The idea is to give doctors more tools to support patient wellness, especially for managing pain, sleep, and inflammation without adding new prescriptions.

ACOs are groups of doctors, hospitals, and other providers that work together to coordinate care for Medicare patients. When an ACO joins the BEI, they can allocate up to $500 per patient per year toward qualifying CBD products. The patient pays nothing out of pocket.

Does Medicare Part A or Part B Cover CBD Oil?

No. Medicare Part A covers hospital stays and inpatient care. Part B covers outpatient visits, preventive care, and certain medical equipment. Neither covers CBD oil directly. CBD isn't classified as a prescription drug, and it isn't approved by the FDA as a medicine (except for one specific epilepsy drug called Epidiolex).

The BEI is separate from Parts A and B. Think of it as a supplemental wellness benefit that certain ACOs can offer on top of standard Medicare coverage.

Does Medicare Part D Cover CBD Oil?

No. Medicare Part D does not cover CBD oil. Part D is the prescription drug benefit, and CBD isn't a covered drug under that program. If you've been told CBD is covered through Part D, that's not accurate. The real coverage pathway is through the BEI.

What CBD Oil Qualifies Under the BEI?

Not every CBD oil on store shelves qualifies. The BEI has specific standards products must meet:

  • Hemp-derived: Must come from legal industrial hemp with less than 0.3% Delta-9 THC
  • Third-party tested: Must have a Certificate of Analysis (COA) from an accredited lab
  • Accurately labeled: CBD content on the label must match the lab results
  • No prohibited additives: Products can't contain unapproved ingredients
