Medicare BEI CBD vs. Over-the-Counter CBD

BEI-qualifying CBD and most over-the-counter CBD products look similar on the shelf, but they're not the same thing. CMS sets strict standards that products must meet to qualify under the Substance Access Benefit Enhancement Initiative (BEI), and most retail CBD fails those standards due to mislabeling, lack of independent testing, or questionable ingredients. Here's what separates BEI-compliant CBD from the average bottle at a gas station or health food store.

For the complete picture on the BEI program, see our Medicare CBD guide.

Quick Facts
  • BEI-qualifying CBD must be hemp-derived, accurately labeled, and third-party tested
  • Studies have found that a large percentage of retail CBD products are mislabeled
  • CMS requires a Certificate of Analysis from an accredited independent lab
  • Prohibited additives or synthetic ingredients disqualify a product from the BEI
  • Edify products are built to meet BEI standards whether purchased through Medicare or directly

What CMS Requires for BEI Eligibility

To qualify under the BEI, a CBD product must meet all of the following:

  • Hemp derivation: Must come from industrial hemp with less than 0.3% Delta-9 THC
  • Third-party testing: Must have a Certificate of Analysis (COA) from an accredited, independent laboratory
  • Label accuracy: The CBD content and cannabinoid profile on the label must match the lab results
  • Clean ingredients: No unapproved additives, synthetic cannabinoids, or harmful contaminants
  • Documented quality controls: The manufacturer must have traceable production standards

These aren't just nice-to-haves. They're required. If a product fails any one of these, it doesn't qualify for the BEI.

How Most OTC CBD Fails These Standards

Mislabeling Is Widespread

Independent studies have repeatedly found that a large share of CBD products sold at retail don't contain what their labels claim. Some have significantly less CBD than advertised. Others have more THC than allowed. A 2019 study published in JAMA found that nearly 70% of CBD products sold online were either under- or over-labeled. The BEI's testing requirement is specifically designed to catch this problem.

No Independent Lab Testing

Many retail CBD brands claim to be "lab tested" but don't provide accessible, batch-specific results. A general statement on a website isn't the same as a current COA that matches the product you're holding. BEI qualification requires a real COA tied to the specific batch.

Questionable Ingredients

Cheap gummies often contain artificial colors, corn syrup, melatonin, or synthetic flavoring agents. Some products include additives that aren't approved for use in dietary supplements. These disqualify a product from BEI participation regardless of the CBD quality.

No Supply Chain Transparency

CMS expects ACOs to source products from manufacturers with documented quality controls. A brand that buys raw material from multiple anonymous farms, blends it in a contract facility, and slaps on a label doesn't meet that standard. Brands with vertical integration and traceable supply chains are a much better fit.

What Makes BEI-Compliant CBD Worth Choosing on Its Own

Even if you're not accessing the BEI through Medicare, the standards it requires are a good benchmark for any CBD purchase. A product that passes the BEI bar is one you can trust. Here's what to look for:

  • A current COA accessible by QR code or batch number
  • USDA organic certification for the hemp source
  • Vertically integrated production (grown, extracted, and formulated by the same company)
  • Nano-enhanced formula for better absorption
  • Ingredient list with nothing you can't identify or pronounce

How Edify Stacks Up Against These Standards

Edify was designed from the ground up to meet these standards. We're a Kentucky family farm. We grow, harvest, extract, formulate, and package everything ourselves. That's what Seed-to-Self means. No third-party farms, no mystery ingredients, no contract blenders.

Every batch is tested by an independent, accredited lab. The results are accessible via QR code on every product. Our hemp is USDA organic. Our gummies are vegan, made without melatonin, artificial dyes, or synthetic additives. Our formulas are nano-enhanced for better bioavailability.

These aren't marketing claims. They're verifiable. Check our lab results and COAs or learn about our farm on our USDA organic farm page.

What to Ask When Evaluating Any CBD Product

Before you buy any CBD, ask:

  1. Is there a COA for this specific batch? Can I access it easily?
  2. Does the lab report match what's on the label?
  3. Where is the hemp grown, and is it certified organic?
  4. Who manufactured this, and do they control the full process?
  5. What's in the ingredient list, and can I identify everything on it?

If a brand can't answer all five questions clearly, that's a signal to keep looking.

What Products Should I Consider?

Edify makes a range of products that meet BEI quality standards and are available for direct purchase:

Should I Get BEI CBD or Buy My Own?

If you qualify for the BEI, getting CBD at no cost through your ACO is the best financial decision. But make sure the products your ACO provides meet the standards described above. If they don't, or if your ACO doesn't participate, buying direct from a trusted brand is the right call.

Edify gives you the same quality whether you're accessing us through the BEI or directly. The difference is who pays for it.
