Does Medicare Part D Cover CBD?

No, Medicare Part D does not cover CBD. Part D is a prescription drug benefit, and CBD doesn't qualify as a covered prescription drug under standard Medicare rules. The real pathway for CBD coverage is through the Substance Access Benefit Enhancement Initiative (BEI), which is a separate CMS Innovation Center program that operates through Accountable Care Organizations, not through a pharmacy benefit.

What Is Medicare Part D?

Part D is the optional prescription drug coverage that Medicare enrollees can add to their coverage. Private insurance companies administer Part D plans under contract with Medicare. Each plan has a formulary, which is a list of covered drugs. To get covered, a drug typically needs FDA approval and a billing code that pharmacies can use.

CBD doesn't meet these requirements for standard coverage. It's not on any Part D formulary because it isn't classified as a prescription drug for general wellness use. The one exception is Epidiolex, an FDA-approved cannabidiol drug for treating two rare forms of epilepsy. If a doctor prescribes Epidiolex specifically, Part D may cover it. But that's different from general-use CBD oil or gummies.

Why Can't Part D Just Add CBD?

It's not a simple administrative choice. Part D coverage requires that CMS approve a drug through the standard formulary review process. That involves FDA approval, safety data, clinical efficacy evidence, and a billing code. CBD hasn't gone through that process for general wellness use. Until it does, it won't appear on any Part D formulary.

The BEI was created precisely because Medicare wanted a way to give certain patients access to hemp wellness products without waiting for full FDA approval and drug classification.

What About Epidiolex?

Epidiolex is an FDA-approved prescription drug containing purified CBD. It's approved for treating seizures associated with Lennox-Gastaut syndrome, Dravet syndrome, and tuberous sclerosis complex. If your doctor prescribes it for one of these conditions, Part D may cover it.

But Epidiolex is a specific pharmaceutical product for rare conditions. It's not the same as the CBD gummies and oils most people are asking about. For general wellness use, Part D is not the answer. The BEI is.

So How Does CBD Coverage Actually Work Under Medicare?

Through ACOs enrolled in the Substance Access BEI. This program is run by the CMS Innovation Center. It lets ACOs include qualifying hemp-derived CBD products as supplemental benefits for their Medicare patients. Eligible patients can receive up to $500 per year in qualifying products at no cost.

This isn't a pharmacy benefit. You don't take a prescription to a drugstore. Instead, your ACO manages product selection, ordering, and delivery directly.

Does Medicare Advantage Part D Work Differently?

Medicare Advantage plans often bundle Part D drug coverage together. The rules for CBD under Medicare Advantage Part D are the same: CBD isn't covered as a prescription drug. However, Medicare Advantage plans can offer supplemental benefits beyond what Original Medicare covers, and some include wellness-related products. This is separate from Part D.

Could Part D Cover CBD in the Future?

It's possible, but it would require either FDA approval of a CBD product for a condition that Part D covers, or a formal rule change from CMS. Neither is imminent. The BEI pathway is more likely to expand first, given that CMS is already experimenting with it as a supplemental benefit model.

Part D is a drug benefit administered through pharmacy networks. It pays for prescription drugs dispensed at pharmacies. The BEI is a supplemental wellness benefit administered by ACOs. It covers hemp wellness products delivered directly to patients. The two programs operate completely separately and have different eligibility and delivery mechanisms.

How Do I Access the BEI If Part D Doesn't Work?

Ask your primary care doctor if their ACO participates in the Substance Access BEI. If yes, they'll help you enroll. If not, you can ask if they plan to join, request a referral to a participating ACO, or purchase CBD directly from a trusted brand.
