What CBD Products Are Approved Under Medicare?

Not every CBD product qualifies under the Medicare Substance Access BEI. CMS set strict standards for what can be furnished through the program. Products must be orally administered, hemp-derived, third-party tested, and within specific THC limits. Inhalable products, topicals used under the BEI, and synthetic cannabinoids don't make the cut.

Product Qualification at a Glance

The CMS Product Requirements in Detail

Oral Administration Only

This is the most important filter. Products must be taken by mouth. Gummies, tinctures, capsules, and softgels all qualify. Anything inhaled, smoked, or vaped is excluded. Transdermal patches and topicals are not covered under the BEI benefit, though they may still be used as complementary products purchased directly.

Hemp-Derived Cannabinoids Only

The cannabinoids in qualifying products must come from hemp plants, not marijuana. Hemp is federally defined as cannabis with 0.3% or less delta-9 THC by dry weight. This distinction matters because hemp is legal under the Farm Bill at the federal level, which is what makes the BEI possible in the first place.

THC Thresholds

Two separate THC limits apply:

  • Product level: 0.3% or less delta-9 THC by dry weight
  • Serving level: 3mg or less total THC per serving

Both thresholds must be met. A product can be within the 0.3% limit at the product level but still fail if a serving size delivers more than 3mg of total THC.

Third-Party Testing Requirements

Products must be tested by an independent laboratory (not the manufacturer) for:

  • Cannabinoid potency (to verify CBD and THC content)
  • Contaminants (pesticides, heavy metals, residual solvents)
  • Microbial hazards (bacteria, mold, yeast)

The test results must be documented and available. This is what Certificates of Analysis (COAs) are for. Without a COA from an accredited third-party lab, a product can't be considered compliant.

No Synthetic Cannabinoids

All cannabinoids in qualifying products must be naturally occurring and plant-derived. Lab-created or chemically synthesized cannabinoids (even if structurally similar to natural ones) are excluded.

What Doesn't Qualify (And What You Can Still Buy Directly)

Under the BEI benefit specifically:

  • Topical products (like our CBD Roll-On Stick) are not covered because they're not orally administered
  • Vapes, tinctures used as inhalants, and smokable products are excluded
  • Any product with synthetic cannabinoids is excluded

That said, topical products like a CBD roll-on are still available for direct purchase and may complement your care plan. They just don't fall under the BEI benefit specifically.
