Medicare CBD Eligibility: Who Qualifies?
Written by the Edify Wellness Team
Not every Medicare patient automatically qualifies for the CBD benefit. Eligibility depends on your doctor's participation in the program, your health history, and a required visit with your physician. If you're wondering whether you qualify, this page walks you through every requirement clearly.
For a broader overview of the program itself, start with our complete guide to Medicare CBD coverage. If you already understand the basics and want to know specifically whether you're eligible, keep reading.
Quick Eligibility Facts
- Your doctor must participate in the ACO REACH Model or Enhancing Oncology Model
- You need a documented shared decision-making visit with your physician
- Patients with substance use disorder or COPD are excluded
- Products must be provided through the ACO, not purchased at retail
- The program covers all 50 states
The Core Eligibility Requirements
The Medicare CBD benefit operates through the Substance Access Beneficiary Engagement Incentive (BEI). To access it, a few things need to be in place:
1. Your Doctor Must Be in a Participating ACO
The BEI is only available through ACOs that have opted into the ACO REACH Model or the Enhancing Oncology Model. These are value-based care arrangements where physician groups and health systems take on financial responsibility for their patient populations. Not every doctor participates. The simplest way to find out is to ask your primary care physician or oncologist directly.
There are 74 ACO REACH organizations operating across all 50 states. That's a meaningful number, and it means patients in most metro areas have access. Rural patients may have fewer options nearby, but many ACOs can work with patients remotely for the counseling portion.
2. You Must Have a Shared Decision-Making Visit
Before your ACO can furnish CBD products to you, your doctor must complete a specific kind of visit called a shared decision-making consultation. This isn't a casual mention at the end of your appointment. CMS requires documentation that the visit covered:
- The potential benefits of CBD for your condition
- The known risks and uncertainties
- Your personal health goals and preferences
- A review of your current medications (to check for interactions)
- A plan for follow-up monitoring
This level of documentation protects you and gives your care team a clear record of the conversation. It also means CBD isn't being prescribed casually. It's being integrated into a real care plan.
3. You Must Not Have an Excluding Condition
CMS has identified certain conditions that disqualify patients from the program. These include:
- Substance use disorder
- COPD (chronic obstructive pulmonary disease)
There may be additional exclusions depending on which ACO model your doctor participates in. Your physician will review your full health history during the shared decision-making visit to confirm you're eligible.
What Conditions Does the Program Target?
The BEI was designed for patients managing chronic or complex conditions where CBD may offer symptom relief. It's particularly active within the Enhancing Oncology Model, which means cancer patients are a primary focus. Common conditions that may lead to a doctor considering this benefit include:
- Chronic pain
- Cancer-related pain or nausea
- Neuropathy
- Sleep disorders
- Inflammation-related conditions
- Anxiety in the context of serious illness
This isn't a list of approved diagnoses. Your doctor determines whether CBD is appropriate for your specific situation. These are just the categories where interest has been highest.
How to Find Out If You Qualify
The fastest path is a direct conversation with your doctor. Here's what to ask:
- "Is our practice affiliated with an ACO REACH organization?"
- "Does your ACO participate in the Substance Access BEI?"
- "Am I a candidate for the CBD supplemental benefit?"
Many patients don't know to ask, and many doctors haven't yet brought it up proactively. You may need to start the conversation yourself. That's normal. The program is relatively new and doctors are still building awareness within their own practices.
If your doctor doesn't participate, you can ask about referrals to providers within a participating ACO or look into whether your insurance plan offers any supplemental CBD benefits separately.
What If You Don't Qualify Through the ACO Program?
If you can't access the benefit through your current care team, you can still purchase qualifying CBD products directly. Edify products are available online and ship to all 50 states. Products like our Soothe Recovery CBD Gummies and Relieve CBD & CBG Tincture, THC-Free meet the same product standards CMS requires for the program.
Direct purchase gives you control over timing, dosage, and product choice without waiting on ACO approval processes. Our Subscribe & Save program can reduce ongoing costs for regular users.
